Any additional work outside the agreed scope is treated as a variation and may incur additional fees.
4. Quotes and Proposals
- Quotes are valid for 14 days unless otherwise stated.
- All quotes are based on the information provided at the time of estimation.
- Changes in scope, timelines, or deliverables may result in revised pricing.
5. Client Responsibilities
To deliver your project on time, you agree to:
- Provide accurate content, branding assets, and required access credentials.
- Review drafts and provide feedback within agreed timelines.
- Ensure you have rights to all text, images, logos, and media supplied to us.
Project timelines may be delayed where required client input is not provided on time.
6. Payment Terms
- A deposit may be required before work starts.
- Milestone and final payments are due as specified in your proposal or invoice.
- Hosting and maintenance plans are billed monthly in advance unless agreed otherwise.
- Late payments may result in paused work or temporary service suspension after notice.
7. Revisions and Approvals
- Each package includes a defined number of revision rounds.
- Additional revision rounds or major rework are billed separately.
- A deliverable is deemed approved once accepted by you in writing or if no feedback is received within 7 days after delivery.
8. Hosting and Domain Services
- Hosting uptime and performance depend on third-party infrastructure providers.
- Domain registrations and renewals remain your responsibility unless we manage them under a written agreement.
- Failure to pay hosting/domain fees on time may cause suspension, expiration, or loss of services.
9. Third-Party Tools and Integrations
Your website may rely on third-party services such as Netlify, Vercel, payment gateways, maps, fonts, plugins, or APIs.
We are not liable for outages, policy changes, pricing changes, or feature removals imposed by third-party providers.
10. Intellectual Property
- Upon full payment, you receive ownership of final approved website deliverables created specifically for your project, unless otherwise agreed.
- We retain ownership of our pre-existing frameworks, reusable code libraries, and internal tools.
- You grant us a non-exclusive right to showcase completed work in our portfolio unless explicitly agreed otherwise in writing.
11. Acceptable Use
You may not use our website or hosted services for unlawful, abusive, fraudulent, or malicious activities, including malware distribution, phishing, or copyright infringement.
We reserve the right to suspend or terminate services that violate applicable law or these Terms.
12. Warranties and Disclaimers
Services and website content are provided on an "as is" and "as available" basis.
- We do not guarantee uninterrupted or error-free operation at all times.
- We do not warrant compatibility with every browser, plugin, or external system unless explicitly scoped.
- You are responsible for maintaining backups unless a managed backup service is included in your plan.
13. Limitation of Liability
To the fullest extent permitted by law, CTCONTECH and CTCON (Pty) Ltd are not liable for indirect, incidental, special, or consequential damages, including loss of data, profit, revenue, or goodwill arising from use of our website or services.
Where liability cannot be excluded, our total liability is limited to the amount paid by you for the specific service giving rise to the claim.
14. Termination, Governing Law, and Contact
Either party may terminate a service agreement in writing subject to any agreed notice period and settlement of outstanding amounts.
These Terms are governed by the laws of the Republic of South Africa. Any disputes are subject to the jurisdiction of South African courts.
